End User License Agreement (EULA) for Coqudo

This End User License Agreement (“Agreement”) is a legal contract between you (“User”) and Methodia S.r.l.s. (“Company”), owner of the Coqudo mobile application (“Coqudo” or the “App”). By downloading, installing, or using Coqudo, you agree to be bound by this Agreement. If you do not agree, do not install or use the App.

2. Eligibility

The App is intended for Users who are:

• 18 years old or older, or
• at least 12 years old with active supervision by a parent or legal guardian.

The App is available worldwide.

3. License Grant

Coqudo is licensed, not sold. Methodia grants you a limited, non-transferable, non-exclusive license to install and use the App on iOS or Android devices owned or controlled by you, strictly in accordance with this EULA.

4. Restrictions

You expressly agree NOT to:

• copy, reproduce, or distribute the App or any part of it;
• modify, translate, adapt, or create derivative works based on the App;
• reverse engineer, decompile, or attempt to extract the source code;
• sell, rent, sublicense, or commercially exploit the App without written consent;
• bypass or interfere with security or technical protections;
• use the App for any illegal or unauthorized purpose.

5. User-Generated Content

Coqudo allows Users to upload images, descriptions, reviews, and communicate through an internal chat.

5.1 Prohibited Content

Users are strictly prohibited from uploading or transmitting:

• illegal or harmful content, including stolen goods;
• content violating copyright or intellectual property rights;
• offensive, abusive, or discriminatory material;
• fraudulent, deceptive, or misleading information;
• spam or malicious files;
• inappropriate or abusive messages via the in-app chat.

5.2 Account Suspension

Methodia reserves the right to suspend or permanently ban any User who violates this Agreement or behaves inappropriately toward other Users.

6. Marketplace Disclaimer

Coqudo is a peer-to-peer platform that allows Users to lend or rent items. Methodia:

• is not responsible for the condition, quality, legality, accuracy, or safety of items;
• does not guarantee that Users will fulfill agreements;
• is not liable for loss, theft, damage, disputes, or any outcome of transactions between Users;
• provides no warranties, express or implied, about User interactions.

7. Payments and Commissions

Payments are processed exclusively through Stripe. Coqudo acts only as a technical intermediary and does not manage payment card data.

7.1 Commissions

Coqudo applies a platform fee equal to:

• 5% commission of the transaction value, plus
• €0.80 fixed fee per transaction.

7.2 Disputes

Any disputes related to payments, refunds, or chargebacks must be handled directly with Stripe. Coqudo does not intervene and bears no responsibility.

8. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. Methodia disclaims all warranties, including:

• fitness for a particular purpose;
• availability or uninterrupted functionality;
• accuracy or reliability of information;
• absence of bugs or errors.

9. Limitation of Liability

To the fullest extent permitted by law, Methodia shall not be liable for:

• direct, indirect, incidental, or consequential damages;
• loss of items, data, revenue, or reputation;
• issues caused by third-party services (Stripe, Google Maps);
• damages arising from User interactions or transactions.

Since the App is offered free of charge, Methodia provides no compensation or indemnification for any reason.

10. Third-Party Services

The App integrates services from third parties, including:

• Google Maps (geolocation, maps, address lookup);
• Stripe (payment processing).

Use of these services is subject to their respective Terms and Privacy Policies.

11. Automatic Updates

Methodia may release updates, bug fixes, or improvements. By using the App, you agree that updates may be automatically installed without additional notice.

12. Termination of Account

Methodia may terminate or restrict access to the App at any time, with or without notice, for violations of this Agreement or for technical, legal, or security reasons.

13. Changes to This Agreement

Methodia may modify this EULA at any time. Updated versions will be made available within the App or on the official website. Continued use of the App after updates constitutes acceptance of the modified Agreement.

14. Governing Law and Jurisdiction

This Agreement is governed by the laws of Italy. Any dispute shall be exclusively submitted to the jurisdiction of the courts of:

Rome, Italy.
